In accordance with Sections 26(3) and 94 of the Community Charter , notice is hereby given that the City of Prince Rupert (“City”) intents to exchange lands owned by the City with lands owned by the Canadian National Railway Company (“CN”).
The legal description of Lands owned by the City are as follows: PIDs: 031-712-746, Lot A, District Lots 507 and 7381, Range 5, Coast District, Plan EPP117677; 031-712-771, Lot D, District Lot 7381, Range 5, Coast District, Plan EPP117677; and 012-247-391, a strip of land 100 feet in width across Waterfront Blocks D, H and K District Lots 251 and 1992 Range 5 Coast District on Plan 923, except Plans 1871 and 12136, except that part shown in Plan EPP128451.

The legal description of Lands owned by CN to be exchanged for the City Exchange Lands are as follows: PIDs: 032-070-632, Lot 1, Waterfront Block E, District Lots 251 and 1992 Range 5 Coast District, Plan EPP128626; 032-070-608, Lot 1 Waterfront Block E Range 5 Coast District Plan EPP117678; and 032 -070-616, Lot 2 Waterfront Block E, District Lot 1992 Range 5 Coast District Plan EPP117678 (“CN Lot 2”).

In connection with the City’s acquisition of the CN Lands from CN, CN Lot 2 will be dedicated to the City as road on Plan EPP133713 (the “Road Dedication Area”). The City intends to grant to CN an easement for access (“Access Easement”) over that portion of the Road Dedication Area shown outlined in bold on Plan EPP133714. The Access Easement will be granted for nominal consideration and may be used by CN for the purposes of gaining access to and from CN’s nearby properties (the “Benefitting Properties”) for so long as CN remains the fee simple owner of the Benefitting Properties.
